Ted Davis was shot and killed by a sheriff's deputy in Nesika beach two years ago; Ted's widow has filed a $26 million lawsuit in U.S. District Court. The suit names Detective Dave Gardiner, Sheriff Charles Denny, and Curry County. Curry County Commissioners were served copies of the suit Tuesday, February 10,1998. Susanna Eve Davis, widow of Edward T. Davis filed for wrongful death. The shooting took place in Nesika Beach. Ted Davis had returned home from work to find a man in his driveway dressed in scruffy cloths, in an old van with California license plates. Davis ordered the man from his property. Detective Dave Gardiner attempted to identify himself by showing Mr. Davis a business card. He did not show a badge or proper identification. When Gardiner did not leave, Davis went into his house and armed himself with a pickaroon. He came out of the house and again ordered Gardiner to leave the property. "At this point, Defendant Gardiner exited his vehicle, drew his weapon, and ordered Mr. Davis to stop, or he would shoot." Mr. Davis did indeed stop, raised his hands in surrender, and backed up two steps, whereupon he was shot and killed by Gardiner," the suit stated. The suit seeks $12.5 million for economic loss, and loss of care, companionship and loss of consortium. It seeks $100,000 puntitive damages from Gardiner. The suit states that his conduct was "willful, wanton, and undertaken by him in reckless disregard and wanton indifference to the rights secured the decedent by the Constitution of the United States", as stated in the suit. The suit seeks $500,000 in compensatory damages, and $500,000 in punitive damages from Sheriff Denney and the County. It said the sheriff had a practice amounting to "willful indifference" that violated the decedent's rights. The sheriff "knowingly" failed to adequately train or supervise his deputies. This failure "directly" contributed to Davis' death, the suit stated. |
Thanks for the info. This case looks worse than I originally thought, and that was bad enough. How much justice is there when the people of the county are ordered to pay for the misdeeds of the individual county employee? How do you trade dollars for a life? You don't. |
Yes. Maybe the question is: WHY do you trade dollars for a life? Maybe the answer IS regarding "How much Justice..." ANY MODICUM!! Maybe the answer is the tail wagging the dog... as we look the other way in silence interpreted by those with ears to hear as our approving of the status quo... There is the matter of the kid, and not just any kid - he was the metaphoric son-in-law of Ken Kesey's Never Give Up, being shot by a cop, and not just any cop - he was/is a paid employee of the government; an undercover narc that has gone so far off the deep end in how seriously he takes his job that he is necklaced with marijuana tattoos and deals and kills. Then there is the matter of We the People having to pay for the county's wrongful deaths and other wrong doings. Unfortunately, that is just the tip of (All the power to the Curry) County iceberg. The war on drugs in the county is the joke of the century. Law enforcement is bought; lock, stock and gun barrel, drugs distribution interests run the county. Port. Airport. Cemetery... Oh, also, it is said by some that these guys are the militia in Curry County; at least night riders. And if that isn't bad enough, in their midst is a lawyer who I HEARD SAY: "The Law is Just" but who routinely uses and abuses the law in behalf of the highest bidder which happens to be the Curry County government, both the elected version and the one that in fact runs the enforcement of business as usual. There is the matter of another lawyer representing the counties, who even the junkyard dog lawyers in Oregon, and some judges in the federal courts are afraid of. Then there are expert witnesses who you expect to take payment from whoever pays them to say what is required, on both sides. ok. But that's business. There are known expert witnesses who take money from either side and say what they say for their two masters, one at a time and get away with it. We pay, and look the other way... So, what to do about the bastards? It is a complicated situation. I read your stuff every day, on the days you comment on the materials. While you more than anyone I ever read stated MY position on Militia better than anyone I'd ever read, there are philosophical areas where I really don't agree with you at all: I am as fiercely anti-zionist as any Shi'ah fundamentalist you'll ever meet. In fact I am also anti-Israeli, and I am anti-JDL and anti-the Jewish Lobby besides. BUT, before God, I am NOT an anti-Semite by any stretch of anyone's imagination or mischief!! There are Christians who call themselves Christians but they are the Synagogue of Satan. There are Jews who call themselves Jews but they are the Synagogue of Satan. There are Muslims who call themselves Muslims but they are Wahabbi and of the House of Sa'ud, and who in their spare time own and run Texaco. The tail wagging the dog isn't a war with Saddam to distract us from what the Presidency of this country has been reduced to, and the White House and the Lincoln bedroom becoming laughing stock fodder for the mideast at the same time. The tail wagging the dog IS little tiny Israel wagging the whole goddamned world and using the power of the United States government to do it; at the expense of the US taxpayer, sure enough, but also, where corruption equates to poverty, all the way down to the poorest of the poor in this country AND the poorest of the poor in every country on this planet where their government leaders get the US government nod of approval, and our taxpayers dollars directly, and indirectly, our time, precious time, and sweat! The powers that be have us paying for poverty to be a fact of life in all too many human lives. They're punking us off. The non-aristocracy of the British Empire, men, are punked-off from birth. Our Founding Fathers knew that from the beginning of this country. Now we as a nation and as men are being punked off by Israel. In other words, for little tiny Israel to get away with what they get away with at US taxpayer expense gives license for every tin-horn off-the-shelf agency within THE agency to commit murder; speaking of night riders, and what the founders of this country had in mind at best. Meanwhile back at the county... Those creeps are doing a daily number on us and the Militia, such as it is or isn't isn't doing anything about it EXCEPT perpetuating the status quo; in my opinion: The highest of high crimes AND social irresponsibility!! Where we disagree, it will be difficult. But without the likes of you and me coordinating our efforts to clean up the neighborhood, WE will get more of the same. |
This is an issue involving unresolved murders and attempted murders. This is an issue that negates, or should negate, any philosophical differences regarding religious beliefs. Every religion, whether Christian, Muslim or other, sharply condemns what has and is occurring in Curry County. The simple answer is this: Where a government has become so overwhelmingly corrupt as to insinuate itself in all levels of life, including the cover-up of murders committed by agents of the local government, the people must arise and impose what they know to be a just and proper response. The only just and proper response to a murder is to kill the murderer in order to discourage further murders. |
